DaVinci Spas Limited Warranty

Purpose of the Warranty
This warranty outlines the terms and conditions under which DaVinci Spas provides repair and replacement services for its products. It is designed to protect the original purchaser while setting clear responsibilities and limitations.

Key Warranty Requirements
To help you understand your responsibilities under this warranty, below are key requirements. This summary is for reference and does not replace the full terms of the warranty detailed as follows.

  1. Upon delivery, carefully inspect your spa for visible damages. Report any issues to DaVinci Spas within 48 hours to ensure coverage for delivery-related concerns. Warranty issues discovered later must be reported within 5 days, as outlined in the Claim Procedure section.

  2. Your spa must be installed according to DaVinci Spas’ provided guidelines, all local building codes, and safety regulations. Improper installation will void the warranty.

  3. Ensure a pH balance between 7.4 and 7.6 and a calcium hardness level of 50 to 100 ppm. Chlorine, bromine, and other harsh chemicals are strictly prohibited and will void your warranty.

  4. For spas used in commercial settings, heightened maintenance, including frequent water testing and cleaning, is required. Failure to adhere to these protocols will void the warranty.

  5. If a warranty issue arises, notify DaVinci Spas in writing within 5 days. Provide detailed information, including photos, to support your claim.

Claim Procedure

  1. Notify DaVinci Spas in writing by email at service@davincispas.com within five (5) days of when the issue first became apparent. Customers must take reasonable steps to prevent further damage to the spa. Failure to do so will result in denial of coverage for repairs related to the said product.

  2. Provide photos and a detailed written statement describing the issue.

  3. DaVinci Spas will evaluate and process the claim upon receipt of the above information.

  4. Any return of defective parts or associated labor charges must be preauthorized by DaVinci Spas.

  5. Freight charges for returning the entire spa for warranty repairs are the responsibility of the customer.

  6. Costs associated with removing or reinstalling a defective spa or its replacement are the sole responsibility of the customer.

  7. If the spa is returned to DaVinci Spas for non-warranty issues, all costs, including freight, will be borne by the customer.

  8. DaVinci Spas reserves the right to inspect any spa or component claimed to be defective before approving warranty repairs or replacements. Failure to provide access for inspection within a reasonable time frame may void this warranty.

DaVinci Spas’ liability under this warranty shall not exceed the amount paid for the defective product.

Warranty Performance
This limited warranty is extended to the original purchaser/end-user of a DaVinci Spas product, effective from the date of delivery. Spas not purchased from an authorized DaVinci Spas dealer are specifically excluded from warranty coverage of any kind.

DaVinci Spas will, at its sole discretion, repair or replace any spa found to be defective under the terms and conditions of this warranty. DaVinci Spas reserves the right to substitute a spa of equivalent value, either new or reconditioned, for any warranty-related replacement. Any replacement assumes the remaining portion of the original product’s warranty period. Non-defective replacement parts required to perform or complete warranty repairs will not be covered under the terms of this warranty.

Warranty Coverage
Structural Warranty:

  • Stainless Steel Spas: The spa structure is warranted to be free from defects in materials and workmanship for 25 years from the date of delivery.
  • Copper Spas: Copper spa shells are warranted against defects in materials and workmanship for 10 years from the date of delivery. Due to the inherent softness of copper, extra care is required, and improper handling will void the warranty.

Exclusions: This warranty does not cover damage to the spa structure or shell caused by:

  • Improper handling during installation.
  • Improper site preparation.
  • High-usage environments (e.g., frequent use in commercial settings without proper maintenance).
  • Abnormal use, such as standing or walking inside an empty spa, especially in copper spas.
  • Sun damage caused by prolonged exposure when the spa is empty and uncovered.
  • Damage to spa covers resulting from excessive loads, such as snow, water, or walking on the cover.

Customer Responsibilities
Installation Disclaimer: DaVinci Spas does not provide installation services or assume any responsibility for installation. It is the sole responsibility of the customer to ensure the product is installed in accordance with:

  • DaVinci Spas’ detailed installation guidelines provided with the spa.
  • Local building codes and safety regulations.
  • Proper site preparation.

Failure to meet these requirements could result in damage to the product or void the warranty. Customers are encouraged to engage licensed and experienced professionals for installation.

Inspection Requirement: Customers must inspect their spa upon delivery for any visible damage or defects. Reporting any issues to DaVinci Spas within 48 hours helps ensure timely resolution of any delivery-related concerns. Warranty issues unrelated to delivery must be reported within 5 days, as detailed in the Claim Procedure.

Water Chemistry Maintenance: Maintaining proper water chemistry is the sole responsibility of the customer. The following guidelines must be adhered to:

  • pH Balance: 7.4 to 7.6
  • Calcium Hardness: 50 to 100 ppm
  • High mineral content or non-potable water must not be used.
  • Prohibited Chemicals: Chlorine, bromine, and other harsh chemicals commonly used in pool or spa applications are strictly prohibited, regardless of the concentration or amount. Use of these chemicals will void this warranty immediately and may result in irreversible damage to the spa shell or structure.
  • Approved Disinfection Systems: Only ozone, UV, hydroxyl, and hydrogen peroxide systems are approved for use. Improper use or maintenance of these systems will also void the warranty.

Failure to comply with water chemistry guidelines will void the warranty and may result in irreversible damage to the spa shell or structure.

Residential and Commercial Applications
Commercial Installations:

  • Water chemistry must be tested regularly, and at a frequency appropriate to the spa’s usage in commercial settings, to comply with the guidelines in this warranty.
  • Cleaning and inspection schedules must be increased to accommodate higher usage rates.
  • Maintenance logs must be kept to document adherence to heightened care standards. Logs must be provided upon request to maintain warranty coverage.
  • Excessive or prolonged use beyond standard residential or commercial conditions will void this warranty.

Residential Installations:

  • Residential owners are responsible for maintaining water chemistry and general care to the same standards specified in this warranty.
  • The warranty does not cover damages arising from negligence or improper maintenance regardless of use type.

Spa Components
All spa components, including but not limited to pumps, heaters, and electronic controls, are warranted by their respective component manufacturers. Spa owners are strongly encouraged to complete and submit warranty registration forms provided by the component manufacturers to ensure proper warranty coverage. DaVinci Spas acts as a distributor for these components, and any warranty claims must be directed to the original manufacturers.

Purchasers must adhere to all applicable maintenance instructions provided by DaVinci Spas or the component manufacturers to ensure continued eligibility for third-party warranties. In the absence of specific maintenance instructions from DaVinci Spas, purchasers must follow industry-standard practices for maintaining the components. DaVinci Spas does not assume responsibility for component manufacturer warranties or their terms. The customer is solely responsible for the cost of installing any replacement components.

Limitations and Exclusions
The following are excluded from warranty coverage:

  • Damage resulting from negligence, improper use, or failure to follow maintenance guidelines.
  • Wear and tear or deterioration due to normal usage.
  • Damage incurred during installation, transportation, or shipping.
  • Unauthorized repairs, alterations, or modifications to the product.
  • Natural disasters, acts of God, or forces of nature (see Force Majeure Clause for additional details).
  • Water damage of any kind.
  • Excessive usage or prolonged use in environments beyond standard residential or commercial conditions.
  • Costs associated with gaining access to the spa for maintenance or repair purposes (refer to Customer Responsibilities for installation and inspection requirements).
  • Environmental conditions, including exposure to extreme temperatures, corrosive atmospheres, or natural events such as floods or hurricanes.

Force Majeure Clause
Warranty performance is subject to delays caused by force majeure events, including natural disasters, governmental restrictions, supply chain disruptions, or other events beyond DaVinci Spas’ control. Such delays shall not constitute a breach of warranty obligations.

Limitation of Liability and Damages
DaVinci Spas’ liability is strictly limited to repair or replacement of defective products as outlined in this warranty. DaVinci Spas shall not be liable for:

  • Consequential damages, including but not limited to loss of profits, business opportunities, or personal property.
  • Any incidental costs, including removal, reinstallation, or transportation.
  • Bodily injury or property damage claims arising from improper installation, maintenance, or misuse of the spa.

Dispute Resolution
Any disputes arising under this warranty shall be resolved through binding arbitration under the rules of the American Arbitration Association. Arbitration shall take place exclusively in Delta County, Michigan, under Michigan law. The costs of arbitration shall be borne as determined by the arbitrator, except that each party shall bear its own attorney’s fees.

Governing Law
This warranty and its interpretation shall be governed by the laws of the state of Michigan, without regard to its conflict of laws principles.

Transfer of Ownership
This warranty is non-transferable and applies solely to the original purchaser of the product. Any subsequent transfer of ownership voids all warranty coverage unless explicitly authorized in writing by DaVinci Spas.
